Privacy policy

WHO ARE WE?

We are AIC Cadaqués, SL (“AIC”) and we process your personal data as the data controller. This means we are responsible for collecting your data, using it for the purposes indicated below, and protecting it.

FOR WHAT PURPOSES DO WE USE YOUR DATA?

We will use the data you provide for various purposes, such as to respond to your inquiries, either through the contact form or other channels available on our website; to manage the sale, purchase, or rental of properties; to manage your subscription to our newsletter; and, if you wish, to send you personalized communications.

WHY DO WE USE THEM?

The legal basis that authorizes us to process your data varies depending on the purpose of each processing. For example, when you contract our services, we will process your data based on the execution of the contract that binds us, as well as to comply with our legal obligations. If you ask us questions about the properties we manage, we have a legitimate interest in responding to them properly. If we send you our newsletter or commercial communications about our services, it will be because we have previously obtained your express consent.

HOW LONG WILL WE KEEP YOUR DATA?

As a general rule, we will retain your data only for the minimum period necessary, that is, as long as it remains relevant to the purposes for which it was collected. For example, the data you provide to us through the contact form will be retained until we have resolved your query or request; the data we use to send you our newsletter will be retained until you unsubscribe from such communications; and the data obtained to formalize a contract will be retained until the contract is concluded. However, all of these periods may be extended for as long as necessary to comply with our legal obligations. Once these periods have expired, we will delete or anonymize the personal data.

WHO DO WE SHARE THEM WITH?

We will share your data with service providers or external collaborators who perform specific functions for AIC and are necessary for us to provide you with our services (logistics companies, financial institutions, technology service providers, etc.). All of these companies are located in the EU and will process your data in accordance with the instructions and agreements signed with AIC.

WHAT ARE YOUR RIGHTS?

You have the right to obtain confirmation as to whether AIC is processing your personal data. If so, you have the right to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, you may object to the processing of your data or request its restriction.

You also have the right to data portability, not to be subject to a decision based solely on automated processing, to withdraw your consent, and to lodge a complaint with the supervisory authority.

We have forms available for you to exercise all of the aforementioned rights.

When the legal basis that legitimizes us to process your data is your own consent , as a general rule, you are not required to provide us with your personal data. However, please note that we will only be able to provide you with the services you request or grant you access to certain features if you provide us with certain data that we consider necessary for such purposes. These data can be clearly identified on our forms because they are marked with an asterisk (*).

If you do not provide this required information, we may not be able to provide the requested services or may have to provide them incompletely. For example, if you submit a request through our contact form or subscribe to our newsletter, you must provide your email address. Otherwise, we will not be able to respond to your inquiry or send you our newsletters.

RECIPIENTS

To which recipients will your data be communicated?

All data you have provided will be treated by AIC with the utmost confidentiality. Occasionally, in order to fulfill the purposes indicated in this Privacy Policy, it is necessary for us to provide access to your personal data to service providers who support us in the services we offer you. These are trusted third parties located within the European Economic Area (EEA), and they will only have access to your data for the ultimate purpose of enabling us to provide you with the requested services under the best conditions.

Where appropriate, and in accordance with applicable law, we may share personal data with the following categories of recipients:

  • With service providers who perform specific functions for AIC. This category includes, for example, the following:
    • Accounting or administrative managers (for payroll preparation, tax settlement, etc.);

    • Companies or professionals that help us provide technology or digital strategy services, such as web developers or platform providers, hosting services, maintenance and support for our databases and software;
    • Banking entities;
    • Transport or logistics companies;
    • Companies or professionals responsible for providing property maintenance or renovation services (plumbers, electricians, bricklayers, etc.). We may share the property owner's details with them so they can bill you directly for the services provided.
    AIC has signed the corresponding data processing contract with each of the external providers to whom we share our clients' and users' personal data, so that they may process it only in accordance with our instructions and for strictly necessary purposes.
  • With public administrations and registries , within the framework of our activity and our obligations as real estate agents (City Councils, Cadastre, Property Registry, etc.).
  • With other public or private entities , such as judicial bodies, tax authorities, law enforcement agencies, fraud prevention and debt collection agencies, etc., in the event that we are required by law or for our legitimate interests to share certain information with them (for example, in the event of a dispute or in response to a request from a tax authority).

Will your data be transferred to third countries?

No. Currently, all of our providers belong to the European Economic Area (the European Union countries plus Liechtenstein, Iceland, and Norway). If, in the future, in order to provide our services to you, it becomes necessary to share your data with companies outside the EEA, we will only work with companies that offer all the guarantees and sufficient privacy protections in accordance with European legislation, such as, for example, service providers located in the United States that have adhered to the Privacy Shield (www.privacyshield.gov), or companies with which we have signed standard contractual clauses approved by the European Commission.

RIGHTS

What are your rights when you provide us with your data?

First, you have the right to obtain confirmation as to whether or not AIC is processing your personal data. If we are processing your personal data, you have the following rights:

  • Right of access : You have the right to access your personal data. If we are processing your data, you can request the following information from us: what that data is; for what purposes we are processing it; possible communications, assignments, or transfers of your data to third parties; the expected retention period; your right to request that we rectify or erase your personal data or restrict its processing, or to object to such processing; the right to lodge a complaint with the supervisory authority; if we did not obtain the personal data from you, any available information about its source; the existence of automated decision-making, including profiling; and meaningful information about the logic involved, as well as the significance and expected consequences of such processing for you.
  • Right to rectification : You have the right to obtain rectification of inaccurate or incomplete personal data concerning you, for example, in the event of errors, spelling mistakes, changes in the data collected, etc. If we have shared your personal data with third parties, we will encourage them to rectify it in the manner you have indicated, unless this proves impossible or would involve a disproportionate effort. Where appropriate, we will also inform you of the third parties to whom we have provided your inaccurate or incomplete personal data.
  • Right to erasure (“right to be forgotten”) : In certain circumstances, you have the right to request that we delete or permanently remove your personal data when, for example, it is no longer relevant or necessary in relation to the purposes for which it was collected or otherwise processed, when you withdraw the consent on which the processing of your data is based (unless there is another legal ground for its processing), when you have objected to the processing of your data and other legitimate reasons for the processing do not prevail, etc.
  • Right to object : You may object at any time, for reasons relating to your particular situation, to the processing of your personal data based on the satisfaction of our legitimate interests. In these cases, we will comply with your request to object and stop processing your personal data, unless there are compelling legitimate grounds for the processing that override the interests, rights, and freedoms you have asserted, or for the establishment, exercise, or defense of legal claims.
  • Right not to be subject to automated individual decision-making : You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This right is waived if you have given us your explicit consent or if such a decision is necessary for entering into or performing a contract with you.
  • Right to data portability : This is an advanced form of the right of access and means that you can ask us to send you a copy of your data in a structured, commonly used, and machine-readable format (e.g., on a data CD). You can exercise this right in three situations: (i) When the processing is carried out by automated means, that is, without human intervention; (ii) When the processing is based on your prior consent or on a contract; (iii) When you request it with respect to data you have provided to us that concerns you, including data derived from your own activity. The right to portability also means that you can ask us to send your personal data to another controller on your behalf, without having to send it to you first, whenever technically feasible.
  • Right to restriction of processing : You can ask us not to apply the processing operations that would be appropriate in each case to your personal data. In other words, we will only be able to continue storing it, but we will not be able to carry out any other processing activities until certain circumstances occur. For example, you can ask us to restrict your data when you have exercised your rights of rectification or objection (while we are verifying the accuracy of your data or our legitimate grounds for processing it), or when erasure of your data is appropriate but you prefer that we restrict processing instead of completely erasing it. When the processing of your personal data has been restricted, we will only be able to process it (except for its storage) with your prior consent or for the establishment, exercise, or defense of legal claims.
  • Right to withdraw consent : If you have given consent for a specific purpose, such as to authorize us to send you advertising about our products and services, you have the right to withdraw said consent at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.
  • Right to complain to the Supervisory Authority : If you consider that your rights have been violated and that the processing of your personal data is contrary to the provisions of the General Data Protection Regulation, you have the right to lodge a complaint with the supervisory authority in your country, without prejudice to any other administrative remedy or judicial action that you may bring. In Spain, you can exercise this right by contacting the following supervisory authority:

    Name: Spanish Data Protection Agency
    Postal address: C/ Jorge Juan, 6. 28001, Madrid (Spain)
    Telephone(s): +34 901 100 099 / +34 912 663 517
    Website: www.agpd.es

    If you reside outside of Spain, you can also contact the competent data protection authority in your country.

How can you exercise your rights?

We have forms available for you to exercise all of your rights mentioned above, quickly, freely, and easily. Simply request the form and return it to us, completed, using either of the two methods indicated below:

  1. By email : write to us at aic@inmobiliariacadaques.com , attaching a copy of your national identity document.
